Terms & Policies
Please read these documents carefully. They set out the basis on which Barbara Marchetti trading as DrBarbaraMarchettiCoachingPhd provides coaching services and how this website is operated.
Coaching Terms of Business
These Terms of Business set out the terms on which I provide one-to-one menopause support coaching services to consumers. Please read these Terms carefully before purchasing or booking any Services. By placing an order, making a booking, ticking a box to accept these Terms, using a payment link, or paying for any Services, you agree to be bound by these Terms.
1. Information about me
I am Barbara Marchetti trading as DrBarbaraMarchettiCoachingPhD. My address is: Clyde Offices, 2nd Floor, 48 West George Street, Glasgow, G2 1BP. My email address is: barbara@drbarbaramarchetticoachingphd.com. In these Terms, I refer to myself as Coach, I, me or my.
2. These Terms
These Terms apply to the menopause support coaching services that I provide to you, as described on the relevant sales page, booking page, order form, invoice, payment page, email or other written description provided to you before you purchase the Services. 'Client, you or your' means the person purchasing or receiving the Services. 'Package' means the package of Sessions purchased by you. 'Services' means the menopause support coaching services I provide to you. 'Session' means an appointment at which the Services are provided. These Terms apply to you as a consumer — someone buying wholly or mainly for purposes outside of their business, trade, craft or profession.
3. How the contract is formed
You can purchase the Services through an online checkout, payment link, booking page, invoice, email confirmation process or such other process as I may make available from time to time. You are responsible for ensuring that the details you provide when purchasing or booking the Services are complete and accurate. The contract between us will be formed when I accept your order or booking, or when I confirm that I will provide the Services to you. I may decline an order or booking where, for example, the Services are unavailable, there has been an error in the price or description of the Services, or I am unable to provide the Services to you.
4. The Services
You are engaging me as a menopause support coach to provide the Services to you in accordance with these Terms and the relevant Package Description. Unless otherwise agreed in writing, the initial onboarding Session will last for up to 1 hour and 30 minutes, and each subsequent Session will last for between 30 and 60 minutes. I shall provide the Services with due care, skill and ability. Due to the nature of coaching, I do not guarantee any particular results. Your results will depend on various factors, including your personal circumstances, your participation, your commitment, and actions taken by you outside the Sessions.
5. Sessions and rescheduling
Each Session will take place online via Zoom or such other online video platform as we may agree. You are responsible for attending each Session at the agreed time. If you wish to cancel or reschedule a scheduled Session, you must do so using the Zoom scheduler link provided to you, or by notifying me by email, in each case at least 24 hours before the scheduled start time of that Session. If you fail to attend a scheduled Session, or do not cancel or reschedule it at least 24 hours before its scheduled start time, you will forfeit the right to that Session. I will not be obliged to provide a refund or reschedule the Session. I may cancel or reschedule a Session by giving notice to you. If I do so, I will reschedule the Session to the earliest mutually convenient time.
6. Packages
Where you purchase a Package of Sessions in advance, the Package Fee must be paid in full in advance, unless I agree otherwise in writing or unless the Package Description states that payment may be made by instalments. I am not obliged to provide any Sessions until the relevant payment has been received by me in cleared funds. You are responsible for booking and attending the Sessions included in your Package. Unless otherwise stated in the Package Description or agreed in writing, all Sessions must be used within 6 months from the date of purchase. Any Sessions not used within this period will expire and will not be refunded, carried forward or exchanged for any other service, unless I agree otherwise in writing. Nothing in this clause affects any cancellation rights you may have as a consumer.
7. Fees and payment
In consideration of me providing the Services to you, you will pay me the total fee stated in the Package Description for the Package selected by you. The Total Fee will be payable in the currency stated in the Package Description and is the total amount payable by you. I am not currently registered for VAT and, accordingly, VAT will not be added to the Total Fee. The Total Fee is payable either in full in advance before the first Session, or where stated in the Package Description, by monthly payments in advance. Subject to your consumer cancellation rights and any other legal rights you may have, I will not be obliged to provide you with any refunds.
8. Consumer cancellation rights
As you are purchasing the Services as a consumer, you may have a legal right to cancel the contract within 14 days without giving any reason. The cancellation period will expire 14 days after the day on which the contract between us is formed. To exercise your right to cancel, you must inform me of your decision to cancel by a clear statement, for example by email to barbara@drbarbaramarchetticoachingphd.com. If you cancel within the 14-day cancellation period, I will reimburse to you all payments received from you without undue delay and not later than 14 days after the day on which I am informed about your decision to cancel. If you ask me to begin providing the Services during the 14-day cancellation period, you acknowledge that, if you then cancel during that period, you must pay me an amount in proportion to the Services performed up to that point. Nothing in these Terms affects your statutory rights.
9. Your responsibilities and the nature of the Services
You acknowledge and agree that the Services are coaching and support services only. I am not providing medical advice, diagnosis, treatment, therapy, counselling, nutrition advice, fitness advice or any other regulated healthcare service, unless expressly stated otherwise in writing. The Services are not a substitute for advice, diagnosis or treatment from your GP, consultant, therapist, pharmacist or other appropriately qualified healthcare professional. You are responsible for seeking medical advice before making any changes to medication, supplements, diet, exercise, treatment, lifestyle or healthcare arrangements. If you are experiencing a medical emergency, mental health crisis or any situation involving risk of harm to you or another person, you must contact emergency services, your GP, NHS 111, a crisis support service or another appropriate professional service. The Services are not suitable for emergency or crisis support.
10. Confidentiality and data protection
I will keep your Confidential Information confidential and will not disclose it to any third party except as permitted by these Terms — for example, where you have given permission, where disclosure is required by law, where there is a risk of serious harm to you or another person, or where disclosure is made to my professional advisers or service providers as reasonably necessary for the operation of my business. I will process your personal data in accordance with my privacy notice. Where required by data protection law, I will ask for your explicit consent to process special category personal data, including health-related information.
11. Intellectual property and materials
I own, or am licensed to use, all intellectual property rights in the materials, resources, documents, worksheets, recordings, methods, frameworks, processes and other content that I provide to you as part of the Services. Subject to your payment of the Fees, I grant you a personal, non-exclusive, non-transferable, non-sublicensable licence to use any materials provided to you solely for your own private and personal use. You must not copy, reproduce, share, distribute, publish, sell, licence, adapt, record, transmit or otherwise make available any materials or content provided as part of the Services, except with my prior written consent. Nothing in these Terms transfers ownership of any intellectual property rights to you.
12. Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any matter for which liability cannot lawfully be limited or excluded. Nothing in these Terms affects any statutory rights you may have as a consumer. I shall provide the Services with reasonable care and skill. Subject to the above, I shall not be liable for any loss arising from your failure to provide accurate information, failure to seek appropriate medical advice, choices or decisions taken by you following the Services, failure to attend or participate in the Services, or technical issues outside my reasonable control. My total liability to you shall be limited to the total Fees paid by you for the Package giving rise to the claim. I do not guarantee any particular outcome, result, improvement or transformation from the Services.
13. Force majeure
I shall not be in breach of this Agreement, nor liable for any failure or delay in performing my obligations, where such failure or delay arises from circumstances beyond my reasonable control. These may include, without limitation, illness, accident, bereavement, failure of utilities or internet services, technical issues affecting any online platform used to deliver the Services, fire, flood, storm, natural disaster, epidemic or pandemic, industrial action, acts of terrorism, war, civil unrest, or changes in law or regulation. If any such circumstance prevents or delays my performance of the Services, I shall use reasonable endeavours to notify you as soon as reasonably practicable and, where appropriate, to rearrange any affected Session.
14. Entire agreement
You acknowledge and agree that these Terms, together with the relevant Package Description, constitute the entire agreement and understanding between us in relation to the provision of the Services and supersede any previous arrangement, understanding or agreement between us relating to the Services. Nothing in these Terms shall limit or exclude any liability for fraud or fraudulent misrepresentation, nor shall it affect any mandatory rights you may have as a consumer.
15. Variation
No variation of these Terms shall be valid unless it is agreed in writing by both of us. For the purposes of this clause, agreement in writing may include agreement by email, unless a different method of agreement is expressly required by these Terms.
16. Counterparts
If these Terms are signed by the parties, they may be executed in any number of counterparts, each of which, when executed, shall constitute an original, and all the counterparts together shall constitute one and the same instrument. This clause shall apply whether these Terms are signed physically or electronically.
17. Third party rights
A person who is not a party to these Terms shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms. The rights of the parties to terminate, rescind, vary, waive or settle these Terms are not subject to the consent of any person who is not a party to these Terms.
18. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation, including any non-contractual dispute or claim, shall be governed by and construed in accordance with Scots law. Subject to any mandatory rights you may have as a consumer, the parties submit to the jurisdiction of the Scottish courts. If you are a consumer resident outside Scotland, nothing in this clause shall affect any mandatory right you may have to bring or defend legal proceedings in the courts of the country or territory in which you are habitually resident.
19. Interpretation
'Agreement' means the contract between you and me for the provision of the Services, made up of these Terms and the relevant Package Description. 'Confidential Information' means information in whatever form relating to you and your affairs that is confidential to you, including information obtained in connection with the provision of the Services. 'Fees' means the fees payable by you for the Services as set out in the relevant Package Description, invoice, payment page, booking page, email confirmation or as otherwise agreed in writing. A reference to a particular law is a reference to it as it is in force for the time being. A reference to writing or written includes email unless expressly stated otherwise. Words in the singular include the plural and words in the plural include the singular.
20. International clients and online delivery
The Services are provided by me from the United Kingdom and will be delivered remotely by Zoom or such other online video platform as I may reasonably specify. Unless otherwise agreed in writing, all Session times are stated in UK time. You are responsible for ensuring that you have a suitable internet connection, equipment, software and private environment to access and participate in the Sessions. I am not responsible for any failure or delay in your ability to access a Session due to your internet connection, equipment, software, location, local restrictions or any other matter outside my reasonable control. Unless otherwise stated, Fees may be paid in pounds sterling, euros or any other currency made available by me through my payment platform, including Stripe. You are responsible for any currency conversion charges, exchange rate differences, bank charges or other charges applied by your bank, card issuer or payment provider.
